Tony Clayton, one of the attorneys representing the class of 2022 athletes, breaks down their case against the NCAA, Southeastern Conference and SEC Commissioner Greg Sankey. Cory Diaz with USA Today helps break down the biggest concerns around the LSU football team ahead of its season opener versus Clemson on Saturday (6:30, ABC).

So So I got So I think the national media has projected as if LSU is behind this entire deal, and they’re not. This

is about those student athletes and the the the NCAA has treated these young student athletes in an arbitrary and capriccious manner.

And what I mean by that Todd is that um during co uh athletes were given a fifth year. They were like okay you can play

another year cuz you couldn’t play during co. So that would take us back kids who started school 2017, 18, 19,

20, and 21 uh were able to have a fifth year. And then the NCA Sue Sponte or

just out of the blue decided in 2023 to make it mandatory that everyone um will

allow will be allowed to get a fifth year. Well, the problem was that 2022 year, which those folks were seniors in

January of this year, had to make a choice. They were like, because this rule wasn’t in place yet, but but in

January of this year, those young folks had to make a choice. They couldn’t play college anymore. They weren’t allowed to have their fifth year. So, they went to

try out for the pros. They had to enter the draft and and dip their toes into this professional arena. Well, five months later, the NCAA decides upon

itself to say, you know what, I will give everybody five years with the exception of this these students

athletes from 2022. That’s not fair. So, those guys went out there, they didn’t make it or whatever happened to them.

Um, now they’re like, “Wait a minute. If we would have known that we had another year left, we could have we would have

stayed and played our last year in college.” And the way it looks now on the NIO, they probably would have made as much money as they would have made in the pros. So they’re entitled to that.

They have a constitutional right to be treated fairly and equitably just as everyone else. And that is where the problem lies.

would say a probable likelihood that if they lose on Thursday which would mean that you get a a

an injunction. It wouldn’t be an a permanent injunction, but I guess it would be a what a temporary injunction that could last through the football

season that they may either appeal or ask for a stay. Do you think those are possibilities if in fact you prevail the way you think you will?

So that’s a multitude of questions there, but you would have passed the laws. You would have passed the bar exam on that that question. You you you were

spot on. So, so of course the SEC is putting out there that they would comply with the court order. They have no

choice. I mean to say that it’s kind of like when Confucious says dark cloud come it, rain come it or whatever. So they have to because it’s a court order.

So I I don’t think they’re just doing any nicities by complying to the court order. That’s just the rule of law.

That’s what we do in this country. But here’s the issue. So they now have a restraining order in place that restrains them from taking any punitive

action against these kids. So if we were to win Thursday, then we will have what’s called a preliminary injunction,

which means now it moves to a level where you get to have a trial. We get to go do discovery, take depositions of the

NCAA, take deposition of the SEC, and take deposition of guy who I want to depose is Mr. Greg Sanki or whatever his

name is. and find out what in the world made him say whatever he said and issue this this rule that he it would issue

punitive damages against any school that were to follow the laws of this country. So park that now we got that as a side.

Sanki to come in and create this little rule to say, I’m going to punish the schools and and I’m going to do this and

footstep door. So, you have to make sure folks rights are protected. And that’s where we stepped in.

So, so, so that’s where I come into play with these guys who work at LSU. No one at LSU is asking me to do anything um in

terms of this. I represent these children. We I shouldn’t say I. When I say I, I mean this guy named Ryan. And there’s another lawyer named Elliot Abrams who he and I represented, R.J.

So, so, so R.J. has already won his uh preliminary injunction. We had the TTRO and we had a hearing about a week and a

allowed to play collegiate ball because he stepped his toe into the NBA draft.

The problem with that, there’s a statute bylaws 12.21 I think from the NCA that

says any kid that has any involvement uh with the draft of the pros cannot play collegiate ball. Well, here’s the rub.

There are 91 athletes this year alone that played pro ball in England, France, and Europe, and they’re now playing

collegiate ball. And so I asked the question from the from the NCA when we had the hearing, what’s why the disparit

treatment toward American citizens? So, you tell me that a guy from France or Europe or Spain or Africa or whatever can come over here and play college ball

after they made a ton of money playing pro ball overseas. And the NCA guy said, “Well, that’s different because the NBA

is a superior league around the world.” And I said, “Well, I don’t know how true that is. I think we’ve gotten our butts whipped a couple of times by some of

these foreign countries.” And he couldn’t reply. He couldn’t respond to that. And I said, “More so?” Oh, strike that. Then he said, “Well, they’re kind

of like,” he didn’t use this word developmental lead, but he kind of alluded that they were like a developmental type lead. And I said,
